Professor Dershowitz ( and Professor Turley) both made invaluable and superb arguments against impeachment and greatly aided our nation’s understanding of the Constitution
especially with respect to the separation of powers and the understanding of the Founding Fathers as to the rare use of the power of impeachment The second impeachment was a kangaroo court and show trial orchestrated by the Democrats
I didn’t do the full research on this impeachment (you might be right) but I strongly disagreed with your points about the second impeachment. The two points you made were that you cannot impeach a former president and that he said “peacefully and patriotically”. First of all, they impeached him when he was president and just had the trial after he was removed from office BECAUSE mcconnell delayed the vote. And then mcconnell said you can’t impeach a former president. This obstruction alone should’ve justified the vote. Additionally, this impeachment showed that a president about to leave office cannot commit a crime (or violate the constitution in this case) and just get away with it. There is no law about inciting an insurrection. The only way to punish Trump was through impeachment. And for the second point, if you actually watched the prosecution’s arguments they mostly focused on Trump repeatedly saying “stop the steal” at rallies and on twitter. What does stop the steal mean? What does it mean when two days before the 6th he tells his supporters to go to washington at the *exact* time the vote was being held and stop the steal. With them saying “hang mike pence” and “where’s pelosi” it doesn’t take an idiot to realize that murder was on their mind. If you kill enough congressmen that were going to certify the vote, all you have left are the congressmen who object and then Trump gets inaugurated. Also to the “peacefully and patriotically” point, they were already in the capitol at that point. The inciting happened in the weeks and days before the 6th.
Sorry Impeachment not appointment. Typo
If I remember correctly you were 82 when you made this speech. To be so mentally sharp at 82 is a blessing.
I was the oldest person ever to argue against a presidential appointment
Thank you for helping us lay folk understand the legalities of impeachment. We need honesty and not partisan action. Bring back the podcast soon!!!
You are blessed Mr Dershowitz. Thank you for continuing the struggle.
