Probably need a law saying disclosure of documents regarding a pending case where the Court has not published its final opinion is a criminal violation and permanent revocation/barring any from the Supreme Court Bar (maybe bar them from becoming a member of any federal or state BAR. I would also make clerks sign a non-disclosure agreement with some sort of punishment in addition to dismissal from a clerkship.
I had to sign something akin to an NDA in 1989 and I was just an intern--not a clerk and, as an intern I did not work on anything that had to do Court’s decision making process.
How many people had access to this information? I can imagine it was a large group. They can definitely figure out who it was. They just don’t want to. What a shame. I appreciate your follow up on this story. It’s important!
