What jurist excuses perjury by an attorney functioning as an officer of the court ?

In my 52 years with US Courts : NONE, NEVER !

Paul, your outrage is justifiable.

However, Judge McAfee did not condone Ms. Willis' actions in the court room--his assessment was did the defense meet the bar for disqualification.

Still, the disqualification is immaterial.

The bigger question is can Ms. Willis continue given how badly she has tainted the jury pool statewide?

Judge McAfee has not ruled on this.

Likely when the defense petitions his court for a change of venue due to the tainted jury pool it will become evident Fani Willis cannot continue on as the prosecutor.

Mr. Dershowitz, Judge McAfee is up for election in May,, facing an electorate that overlaps a great deal with the same electorate that voted Willis in by a landslide in 2022. Before you begin fulminating about the integrity of judges and electoral considerations must have no place, remember these two things:

1. For years you worked for the Harvard Law School,, an aquarium of 200 proof cynicism, with no visible distension of your nostrils from the stench.

2. Most of your readers are powerless. They can do nothing about Judge McAfee's ruling. But you, with your fat Rolodex, can take note of Georgia's recall laws, which would allow the recall of both WIllis and McAfee. Go ahead, get a recall committee started.

See how far you get.

Gregory, you hit it right on the mark.

Judge McAfee is up for re-election and given all the information presented on both sides of the argument, of disqualification the Judge got it more right than wrong.

Furthermore, he left the door wide open for the defendants to petition the court for a change of venue, which would likely remove Fani Willis from the case.

McAfee is the only adult in the room.

The important issue in this case is the judge's failure to address criminal perjury and obstruction of justice by Willis, Wade, et al.

You called the result a couple weeks ago; but I believe since attorneys and key witness were black; judge feared the racist card being played. Ridiculous decision; both careers are over. I don’t care about Trump at all !!

Trump should immediately appeal the case to the appellate court!

Expand full comment

He did and Judge McAfee allow him and the co-defendant to immediately appeal.

Fani Willis is a zealot and has tainted the entire jury pool in Georgia.

Expect a petition by Trump and the co-defendants for a change of venue--this will result in Fani Willis eventually being removed, as there is no fixing the jury pool issue without her removal.

Once you convince yourself that your tribe is the only thing standing between a 70M strong hoard of racist, rageful, rural white nationalists that want to bring fascism to America... you are allowed to do pretty much anything. Norms? Judicial rules? Laws? All must give way to stop the Orange Fuhrer.

Let's say Donald Trump actually wins in November. Anyone want to lay odds on the Democrats voluntarily relinquishing power?

Obama people are certainly pulling the strings with Biden, but there's nothing weird about that historically. I'm talking about the Democratic Party actively attempting to usurp the obviously expressed and legal will of the people. In 2024, they stacked the deck, which is also part of the game, but I'm talking about a step beyond that.

For example, let's say the House of Representatives goes Democrat (I know, unlikely, but possible) but Donald Trump wins 300 electors 42% of the popular vote, splitting it with Biden and Kennedy. In a world where both parties believe the other had a legitimate right to rule, that's not a problem. In the world we have, I am 95% certain that the new Democratic Speaker of the House would find a reason to refuse to certify a few states and therefore throw the election into the House, where they would elect Joe Biden. They would do EXACTLY what they are currently prosecuting Trump for wanting to (but not) doing. That is the sort of thing civil wars are made of. All it takes is a governor ordering his national guard to obey Donald Trump as the duly elected President and it's all over. Remember those 25 states that sided with Texas over the border? Many would side with whoever did that too.

To be completely fair, I do not believe Joe will be the nominee; he will drop out for some nebulous medical reason at the convention. Who they will draft I don't know, but I expect someone famous with limited political experience, an younger outsider who will "drain the swamp". And that person will likely win, since the only person in America less popular than Donald Trump is Joe Biden.

Federal, State Officials Aiding Criminal Misconduct, Corruption, Injustice and Sexual Abuse "Under Color of Law"

Eighty traffic stops in four years. Five robberies. Home invasion and death threats by armed Sheriff Deputies with AR-15s and shotguns pointed at my head and at my dog "Boomer's" head while two young children were mere feet away on a second floor. False arrest. False imprisonment. Actionable evidence including recordings, documents, hundreds of witnesses contact information with no conflicts of interest esp. regarding crimes against children involving rape and abuse.

Only EXTERNAL demands might drive long-overdue official accountability, investigation, oversight, an end to abuses, brutality, crimes of a community & local, State & Federal corruption that would shock most Americans. It sounds unbelievable, but is very much real in Wilmington N.C.

Though provided irrefutable almost certainly admissible evidence of criminal activities involving:

U.S. Department of Justice & F.B.I. involvement in extensive criminal misconduct by Corrupt North Carolina officials including sexual abuses of children, theft of Federal funds, lynching's, retaliatory murders, torture, violence & retribution against child victims, families & the few who have dared discuss horrific abuses suffered & retaliation by officials, prosecutors & bribed media. This "Culture of Corruption," once pursued, is now Assisted, Protected by the U.S. DOJ, FBI USAO despite vast evidence & growing #s of victims of violent criminal acts that any remotely moral person would conclude:

CONGRESS MUST HOLD THESE FEDERAL OFFICIALS AND THE STATE AND LOCAL SADISTIC CRIMINALS OFFICIALLY PROTECTED TO ACCOUNT.

NO OFFICIAL WHO ENGAGES IN SUCH EVIL SHOULD EVER BE MAINTAINED OR SUPPORTED IN OR ALLOWED TO HOLD PUBLIC OFFICE OR PRACTICE LAW EVER.

She is tainted for the future and will never recover her believability , It is better for Trump that she continue than that a respectable prosecutor replace her.

Maybe, by allowing her to continue, she will discredit herself further, and the holdouts in Fulton will finally be shamed into getting rid of her. Trump continues to reap the benefit of the obvious assaults. Of course, this has nothing to do with the law or justice.

The elite are extremely desperate. They're lashing out in all directions, as their financial system is being threatened by decentralized modes of banking. These buffoons are so desperate for Klaus Schwabs great reset that they're willing to do anything, including start world war 3, to get it. Trump, of course, is there number one target. The great reset cannot happen if Trump wins.

Far too often it appears that justice has become nothing more than a meaningless word. Our two political parties have undergone a metamorphosis. The party of Joseph McCarthy has become the Democratic Party while the democrat party has evolved into one of intolerance, injustice, deceit, censorship, propaganda & obfuscation.

Expand full comment

But Joseph McCarthy turned out to be absolutely correct about the Soviet infiltration and subversion of the USA. Meanwhile, the Democratic Party was always the party of the KKK, Jim Crow laws, blocking anti-lynching and desegregation bills, ballot fraud, and complete and utter corruption. They didn't change. They just got better PR.

I agree, the but I argue they evolved. KKK was eventually defeated and phased out but socialist/populists and communists needed a place and there was a void. The messaging part is spot on.

Communists and Nazis are the same people. The deep structure of both ideologies is the same - the world is divided into warring collectives, with one singled out as supremely evil (fill in the blanks according to context.) Both ideologies appeal to the same worldview, the same feelings of simmering resentment.

Imagine for a moment that Fani did pay Wade back in cash. Because they're both attorneys they know they must avoid even the appearance of impropriety. They should have made a record of their transactions, precisely to avoid this appearance, yet they did not. The point isn't that what they did was illegal (because we're presuming here it wasn't), but that they created an appearance of impropriety that can't be expunged because they didn't properly document their transactions. The appearance of impropriety stands, and should have resulted in her removal from the case.

Let me further note that Carter contributed money to Madam Willis' election campaign. This is by definition a conflict of interest. The judge has effectively affirmed that Willis committed perjury.

And that might be intentional. He explicitly said that while GA law required an actual conflict to remove a prosecutor, he believed other venues (GA Bar, AG, Legislature, etc...) could adjudicate those issues.
